What is a UK Spouse visa?

A spouse visa is also called a UK marriage visa, this visa allows married partners of UK citizens to come to the UK since they are married to someone who is settled in the UK, which means they are ordinarily resident in the UK and have no immigration restrictions on the length of time they can stay.

What is the procedure for obtaining a UK Spouse visa?

Visit https://www.gov.uk/uk-family-visa/partner-spouse website and Sign up or sign in with your valid email id.

Fill out an application with details:

  • Your name, your date of birth, your current passport, or other valid travel ID.
  • Copies of the photo page and any visa or entrance stamps from previous passports, a copy of your biometric residence permit, if you have one. 
  • Details of any prior immigration applications you’ve filed; details of any criminal convictions you’ve had; and, if you have one, your national insurance number.
  • If you’re applying from outside the UK, your parents’ date of birth and nationality.
  • If you live in a nation where tuberculosis testing is required, your tuberculosis test results in a certified translation of any document that is not written in English or Welsh.
  • In case you’re applying for a visa from outside the UK, you’ll need a blank page in your passport.

As part of the process, you’ll need to make an appointment at a visa application center to enroll biometric data (picture and fingerprints). You must not only complete the application form accurately, but you must also upload copies of all required supporting papers, which can be numerous.

You may be requested to attend a Spouse Visa Interview if the caseworker assessing your application has reservations about the validity of your connection. You’ll be quizzed on your relationship and each other to check if your marriage is genuine and not a ruse.

What is the cost of a UK spouse visa application?

A spouse visa obtained within the United Kingdom costs £1033. As part of the application, the applicant must also pay a £19.20 biometric enrolment charge.

The spouse visa (designated as a “settlement visa” for entrance clearance) costs £1523 outside the UK. If available in the country of application, the settlement priority service would cost an extra £573.

The applicant must also pay the Immigration Health Surcharge, which is £624 per year (£312 for every six months). Because the spouse visa is valid for 30 months (2.5 years) in the UK, the total premium for leave to remain would be £1560. The visa is issued for 33 months from outside the UK. Thus the total surcharge would be £1,872.

Is it possible to extend a spouse visa UK?

Yes, you can extend your visa for 30 months (2.5 years) at a time if you meet the requirements. To complete your 60-month (5-year) qualifying period for settlement as a partner or spouse, you will need to extend your visa at least once.

If you don’t fully meet the conditions for settlement after five years, for example, if you can’t speak English to the required level for settlement or fail the Life in the UK test, you may need to apply for an extension.

English language requirements for partners:

Applicants must demonstrate that they are fluent in English in both speaking and listening. For your initial application, you must pass an approved English language test with a CEFR level of A1 in speaking and hearing (beginning). To be eligible for a 2.5-year extension, you must pass an approved English language test with a CEFR level of at least A2 l, which is considered an elementary level and is somewhat more challenging than A1. You must demonstrate that you can communicate in English at the B1 level, which is intermediate.

What happens if your application for a Spouse Visa is denied?

You will receive a letter stating the decision if your application is rejected as invalid or refused. If your application is denied, the letter will also include whether or not you have the right to appeal. If you believe the decision is incorrect or unfair, you may consider reapplying or challenging the decision, depending on the grounds for refusal.

Because there may be time constraints for appealing a decision, you should contact an attorney as soon as possible. If you are already in the UK, the adverse decision may impact your present status, so you should seek legal advice to determine how your status and future applications may be affected.

How to renew a UK spouse visa?

You’ll need to fill out an online form (also known as an FLR (M) form) to renew your visa. After paying the required application fees, you must upload scanned copies of your supporting documents to an online site run by the Home Office’s commercial partner.
